Lol how about it is the parents and the kids fault for not watching where their feet were going?

It happen more often then you think. In other countries as well. Crocs are very soft on the bottom, and I would not be surprised it get stuck on things like escalator. It kinda wedge itself in the gap between the lining of a escalator (like a sponge). The lining of escalator itself suppose to be a safeguard.. because back when it was first made, many kids got killed (I learned about this from a documentary show about a huge airport in U.K. on National Geographic Channel)
After many trials and troubles, they finally designed escalator that works. Kids are safer now. I wouldn't change the escalator design at all unless they can come up something better. Its the parents and the shoes that need to improve. We wear shoes for safety otherwise we would go barefoot all day (and sometimes for fashion).

I love crocs, but I am also careful with them like I am careful with high heels on wet floors.

Thats true too, KA, except I'm sure that in certain cases it could happen...for instance if we all go to the mall, we hold the hands of our younger children while the school aged ones go on their own. Its possible for one of them to be careless and let something happen.

I read at the end of the article that flip flops allow this to happen too...so I'm thinking its not JUST the Crocs...right? I don't see how the Crocs ppl could lose this lawsuit, because its almost impossible to make shoes that will hold up under each and every situation in the world. However, escalator people could possibly think of a safer way to make escalators. BUT then it would be the responsibility of each store to update their escalator, so again we can shift the blame. haha.

I don't really see a clear cut lawsuit here, I guess, is my point. Lawsuits are for negligence and I can't see any outright negligence by anyone going on here. Sometimes an accident is an accident. Your kid falls out of a tree..who do you sue....God?

Sue the tree, and or the owner of the property that the tree is on. a good ambulance chasing lawyer would have no problem on finding some one to sue.

Isn't suing a way to blame someone else for ones on? And or the America way t become rich and famous?

As I posted earlier, escalator is the safest it can get. If you change the design on it, it could go back the way it was... sucking kids in and killing them.

We could probably theorize all day who is "at fault" in this situation. I tend to agree with whoever said it was a freak accident (though it didn't take our sovereign God by surprise). I'm no fan of litigation in these types of situations. If it were my child, I hope I'd just accept what happened and go on, knowing that it was God's plan for us. We have far too many "victims" in our society; I don't want to join that number.

It is odd that this has happened so many times when kids are wearing Crocs. Kids can't step as far from the back of an escalator step as adults can, and that could be part of the problem. I know that I have never liked escalators, even when I was a kid...always had a fear of being sucked into one. :lol: Never actually heard of it happening, though.

I tend to agree with Annie. But I would hope also that the store in which the escalator was located would quietly (so as not to encourage others...) help pay the medical fees if the family had no insurance. And I think the Crocs company should offer some help as well. Maybe then, they wouldn't sue. It would have to be horrific to see your child's foot mangled!!!

I agree the store should probably help....I don't know about the crocs company though...I mean...what if it were a flip flop or bare feet?

I guess my brother-in-law should have sued the shoe-string industry for their part in his escalator accident? (His shoestrings got caught and he literally battled to keep his foot uninjured, but he lost his shoe. The store bought him another pair of shoes.)

That's perfect...the store helped, and everything thankfully turned out okay. But that's my point, its not just crocs here. Its flip flops, shoe strings, etc. Its either the escalators...or its just an accident.

Accidents do happen, its a shame everybody sees accidents now as a "finally get rich and pay off our bills" opportunity.

An accident is an accident. The people are not entitled to "help" from anyone. If they get help, great, if not, too bad they weren't "entitled". If they don't have insurance, that's their lookout. The allowed their child to go out in public in crocs. Everyone knows what crocs are like. It's not the fault of the store, the fault of the crocs, or anything like that. As hard as it is for the family to accept, the child chose to wear the crocs and the parents allowed it, so if it is anyones fault it is theirs. Everyone thinks that they are entitled to something these days.

I suppose my husband could sue his employer over the food poisioning he got this week from the cafeteria food...life happens and as hard as it is, it's reality.

No - noone is entitled to help from anyone. But it would be nice if it was offered. That's all I was saying. Yes, parents should keep an eye on their kids. But things happen even when they do. Personally, I wouldn't wear Crocs, nor let my kids. I think they are ugly! :lol:

I remember when I was young I loved escalators, which I would hardly ever see one of them. there is one hospital I go to at Texarkana that has one. I've gone up it a time or 2 and I always think, hey these things have hurt people, I best be careful.

I always take notice of that section were you step on and get off, to me it looks dangerous. I can just see some man whose pants are just a bit to long getting hung up in it and or a woman with a very long dress or skirt, or someone with those long shoestrings and or their shoe strings untied.

When a person gets on a escalator they need to be paying attention to what they're doing, and if not them they should not blame someone else if all goes wrong that can go wrong. At 61 I rather take an escalator that a stair case, those stairs wear me plumb out.

This is weird... every time I click on this thread, the last post (first it was one by HappyChristian, and then one by Jerry#s) isn't showing up... and when I click on "View New Posts", it shows that I haven't read the topic. :puzzled: I keep clicking on it and still don't see the posts... it's so strange!
