We do not have sales tax on necessities, but sales tax on other things. Food and clothing and shoes are not taxed....restaurant food, toys, computers, etc are taxed. (In PA)

I have had this discussion with numerous people. Every one of them says that courts have upheld this, but so far no one has produced the court judgment stating that this is true. Since you have gone to court, you must have a copy of the judgment that you could either post or email us.

It really doesn't effect me as I haven't paid income tax in 15 years. However, who knows what the future holds. You have the burden to prove that the courts are in support of this position. As stated before, many have made the claim, but no one has give documented proof that this is accurate. Until then, I will continue to view this as an illegal venture and therefore contrary to Scripture.

How about this, Tom Cryers are sited on the web and easy to find, so I will post them now, and when I have time and can go dig mine out, I will scan and post them, but we have moved twice and it may take me a little bit to find mine, and I am also in the middle of moving livestock and putting up second cut hay, so please be patient.

Cryer v. United States, 2008-1 U.S. Tax Cas. (CCH) paragr. 50,361 (W.D. La. 2008); Memorandum Ruling, p. 6, docket entry 8, May 9, 2008, case no. 5:07-cv-02206-DEW-MLH, U.S. District Court for the Western District of Louisiana (Shreveport).

You should be able to go to the US District court for the Western District of Louisiana and through the FOIA request copies of these documents, they may even be available for viewing online, I don't know for sure. The first one is the Gov'ts case against Cryer with the final rulings, and the second one is the case Cryer brought against the IRS and the dismissal. Now if you don't want to go find out it's all on you.

Sales tax is State by State, and some States also have Income Tax. Some states have sales Tax and some don't, and inside the states that do have sales tax, some counties, and local gov't also add sales tax.

Right. And here we have sales tax. And state income tax. And county tax - two in fact. And federal income tax. And property tax. *sigh*

I prefer flat tax too. It's good for the environment (not that the gov't cares anyway, even democrats) because the rich buy things.. and if they decide to do a yard sale, the poor can buy off of them without paying taxes. Leaving them to pay tax on food.

but the gov't would never allow this. They are too nosy, and MUST know how much a person makes.. they will say they will make sure no one is paying under wages... and little things like that. businesses still have to do taxes if flat tax exist. but at least no household will be forced to pay taxes.

Uh - there wouldn't be taxes on yard sale stuff...And a higher sales tax, sans the income tax, would actually save people money. The rich are gonna buy what they are gonna buy regardless of what tax there is.

I meant, yard sales would help the poor, not the rich..

It's always been that way, The rich buy.. when they are done with it, they give it to the goodwill or have a yardsale. The poor get what they need from yardsales. The only tax the poor would have to worry about is food and other needs. The poor have always brought second hand things. (someone gotta buy it new in order for someone to buy it used)

The poor still pay income and property tax. The only way they get out of that is if they get money only from the gubmint. Even if people pay rent, they are affected by property tax in their rent payments.

Yes, yard sales are good - but I'm not rich and I've had yard sales!

Look into the idea behind sales tax versus other taxes and you'll see that it is the friendliest tax for the economy.

I thought we are talking about flat tax. you say they still have to pay income... I thought the point of flat tax is to get rid of income tax.

I haven't been talking about a flat tax. A flat tax is just a way to redistribute income, imo. Sales tax is the better way to go, because then people choose what they pay taxes on. And if they choose not to buy a big ticket item because the tax, along with the price, is too high - supply and demand will lower that price, making it more affordable. Then, people will own as much or as little as they want to pay taxes on. Choice, not coercion.

I'd like to see a sales tax - no income tax would be necessary, nor would property tax. And no, no flat tax.

for some reasons, I thought they were the same thing. either way, The gov't would never let that happen. They are getting nosier and nosier every year. They have to know every single details about your life.
