IANAL, but the problem IMO with the SCOTUS' decision is the fact that "cruel and unusual" should be defined outside of the scope of the crime. Either Death is cruel and unusual, or its not. Then the question of whether or not the punishment fits the crime is another decision. (But in looking at the dissenting opinions, it does not seem like Alito or Scalia mentioned that, and normally they would jump all over it... so perhaps I am wrong. That wasn't a direct governmental law. Notice that rule was given to the parents who were to make the determination as to whether their child had crossed the line and needed to be taken to the authorities or not.
